The Moroccan law relating to the protection of individuals with regard to the processing of personal data (Law 09-08) is based on a founding principle for direct marketing (of which SMS is part): Prior consent (Opt-in).

You do not have the right to send a commercial message to a natural person (B2C) if they have not explicitly given their prior consent to be contacted via this channel. In addition, any processing of personal data (the creation of your customer database) must be the subject of a prior declaration to the CNDP.

What is mandatory before sending a campaign

Before even uploading your CSV file to the sending platform (EnvoiSMS), make sure to check these three boxes:

  1. Proof of Consent: How did you obtain this number? If the customer has completed a form on your e-commerce site, there must be a checkbox (not pre-checked) saying "I agree to receive offers by SMS".
  2. Clear Identification (Sender ID): The recipient must immediately know who is contacting them. The use of a validated alphanumeric Sender ID (the name of your brand) is strongly recommended. Impersonating a public institution or hiding your identity is illegal.
  3. The Right of Opposition (The famous "STOP SMS"): Each promotional SMS must include, at the end of the text, a simple and free way to oppose future sendings (eg: STOP to 06XX). And above all, you must respect this choice and blacklist the number in your CRM or via a webhook.

What is explicitly prohibited (Common pitfalls)

La CNDP sanctionne régulièrement les abus. Voici les pratiques à bannir absolument de votre stratégie :

  • L'achat, la location ou l'échange de bases de données "Opt-out" : Acheter un CD-ROM ou un fichier Excel de numéros "CSP+ Casablanca" sans que ces personnes ne vous connaissent est la définition même du Spam.
  • Le contournement par WhatsApp : Certains pensent qu'utiliser WhatsApp Business échappe à la règle du SMS. C'est faux. La loi 09-08 couvre "tous les moyens de communication électronique".
  • L'envoi à des horaires déraisonnables : Bien que la loi marocaine ne fixe pas d'horaires stricts à la minute près comme en France (Loi LCEN), le harcèlement nocturne ou le dimanche (sauf alerte de sécurité urgente ou OTP) est considéré comme une nuisance pouvant déclencher des plaintes à l'ANRT et à la CNDP.
